The Fink Family Law Approach
Many families facing divorce and other family disputes are looking for a result that feels “fair” to everyone involved and that also addresses the individual needs of the parties and their children. In truth, what feels “fair” to one person may seem totally unfair to another person. Some look to the law to define what is “fair,” but each state in the U.S. has its own set of laws for resolving divorce and other family conflicts. There is no way to measure whether one state’s law is more “fair” than the other when the results of a case can be wildly different in different states.
We offer a problem-solving, settlement oriented process, where the people involved are able to consider anything that they believe to be important, and to make their own decisions about reaching a solution. Key to this is making sure that everyone involved has all of the information they need to make the best decision for themselves.
Of course, not everyone involved will necessarily agree on how or why any proposed solution is appropriate or acceptable. At the same time, it is often possible to reach an agreeable set of terms which each person involved feels is a better resolution than the other alternatives available.
The purpose of the legal system is to resolve disputes in a consistent way, but not necessarily in a “fair” way. The law defines what kind of “facts” matter and which do not. A judge may not be permitted to give you the result you want, or even to listen to why you feel that the result you seek would be appropriate. We can help to avoid the limitations and uncertainty by using the courts to resolve family disputes.
